Terms of Service

1. Acceptance of Terms

By accessing or using the ViralFlow platform and its associated services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must not use the Service.

These Terms apply to all users, including visitors, registered accounts, and any organisation whose members access the Service.

2. Description of Service

ViralFlow provides a social media content management platform that enables users to generate, schedule, and publish content to connected social media accounts. Features include:

  • AI-assisted content idea generation and caption writing
  • A content calendar for planning and scheduling posts
  • Integration with Facebook Pages and LinkedIn via official APIs
  • Business context management for brand-consistent content
  • Media hosting and management for social media content
  • Credit-based usage system for premium features

The Service is provided on a subscription and credit-based basis. Specific features, pricing, and availability are subject to change at ViralFlow's discretion with reasonable notice.

3. Eligibility and Account Registration

You must be at least 16 years of age to use the Service. By using the Service, you represent that you meet this requirement.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use at info@viralflow.ink.

You agree to provide accurate, current, and complete information during registration and to keep it updated.

4. Acceptable Use

You agree not to use the Service to:

  • Publish content that is unlawful, harmful, defamatory, obscene, or violates any third-party rights
  • Violate Facebook's Platform Policies, LinkedIn's terms of service, or any other third-party platform's terms
  • Transmit spam, phishing content, or unsolicited commercial messages
  • Attempt to gain unauthorised access to the Service, its servers, or related systems
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Scrape or harvest data from the Service without prior written consent
  • Use the Service in any manner that could damage, disable, or impair it

We reserve the right to suspend or terminate accounts that violate these rules at our sole discretion and without prior notice.

5. Content and Intellectual Property

5.1 Your Content

You retain ownership of all business context, content drafts, captions, and other materials you create within the Service ("User Content"). By using the Service, you grant ViralFlow a limited, non-exclusive licence to process and store your User Content solely to provide the Service.

5.2 AI-Generated Content

Content generated by the AI features of the Service is produced for your use. You are solely responsible for reviewing, editing, and ensuring that any AI-generated content complies with applicable laws and platform policies before publishing.

5.3 ViralFlow Intellectual Property

The Service, including its design, software, trademarks, and all content created by ViralFlow, is owned by ViralFlow and protected by applicable intellectual property laws. You may not use our trademarks or branding without our express written permission.

6. Third-Party Integrations

The Service integrates with third-party platforms, including Facebook (Meta) and LinkedIn. Your use of those integrations is subject to the respective platform's terms of service and policies. ViralFlow is not responsible for the availability, accuracy, or content of third-party platforms or any actions taken by those platforms, including but not limited to suspension of API access, account restrictions, content moderation, or policy changes.

When you connect a social media account, you authorise ViralFlow to publish content on your behalf only as directed by you within the Service. You acknowledge that third-party platforms may change their APIs, policies, or terms without notice, and ViralFlow cannot guarantee continuous availability of third-party integrations.

ViralFlow shall not be liable for any damages arising from third-party platform interruptions, policy changes, or account restrictions.

7. Credits and Billing

Certain features of the Service operate on a credit-based system. Credit amounts, pricing, and availability are subject to change at ViralFlow's discretion with reasonable notice. Credits are non-transferable, non-refundable, and have no cash value unless otherwise specified.

Subscription plans and billing terms are presented at the time of purchase and are incorporated into these Terms by reference. ViralFlow uses third-party payment processors (including PayFast) and does not store your payment card details.

You authorise ViralFlow to charge your selected payment method for subscription fees and credit purchases. You agree to provide accurate, current billing information and to update it promptly if it changes.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

ViralFlow does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. AI-generated content may be inaccurate, incomplete, unsuitable for publication, or may infringe third-party rights — you are solely responsible for reviewing and editing all content before publication.

ViralFlow does not guarantee that content published through the Service will be delivered, displayed, or remain available on third-party platforms. Third-party platforms may remove, modify, or restrict content at their discretion.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIRALFLOW AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND THIRD-PARTY SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

ViralFlow SHALL NOT BE LIABLE FOR failure to publish content due to third-party platform issues, content that is removed or restricted by third-party platforms, AI-generated content that is inaccurate or inappropriate, service interruptions, loss of data or credits, or third-party platform policy changes.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) USD $100.

10. Indemnification

You agree to indemnify, defend, and hold harmless ViralFlow and its affiliates, officers, directors, employees, agents, and third-party service providers from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees and costs) arising from your use of the Service, your User Content, your violation of these Terms, your violation of any third-party rights, or your violation of any third-party platform's terms of service or policies.

11. Termination

You may terminate your account at any time by contacting us at info@viralflow.ink. ViralFlow may suspend or terminate your access to the Service at our sole discretion, with or without cause, and with or without notice, including for violation of Terms, non-payment, fraudulent activity, or platform policy violations.

Upon termination, all credits and subscriptions will be forfeited without refund unless otherwise required by law. Sections 5, 8, 9, 10, and 13 survive termination.

12. Changes to Terms

We may revise these Terms at any time. We will provide notice of material changes by updating the "Last updated" date and, where appropriate, notifying you by email. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.
